{"id":7927,"date":"2022-01-31T10:33:18","date_gmt":"2022-01-31T15:33:18","guid":{"rendered":"https:\/\/360mediations.com\/en\/?p=7927"},"modified":"2022-01-31T10:33:45","modified_gmt":"2022-01-31T15:33:45","slug":"duty-to-immediately-disclose-any-settlement-that-changes-the-litigation-landscape","status":"publish","type":"post","link":"https:\/\/www.360mediations.com\/en\/duty-to-immediately-disclose-any-settlement-that-changes-the-litigation-landscape\/","title":{"rendered":"Duty to Immediately Disclose Any Settlement that Changes the Litigation Landscape"},"content":{"rendered":"\n<p>The Court of Appeal reaffirms that the duty to disclose a settlement that changes the litigation landscape not only applies to the conventional partial settlement structures like Mary Carter Arrangements or Pierringer Agreements, but to any settlement that converts former foes into friends in the litigation.\u00a0 That was the issue in this appeal, and the consequences of not disclosing the settlement was profound \u2013 a dismissal of the action against the remaining defendants.\u00a0<\/p>\n<p>The case is also helpful because it helps define the term \u201cimmediately.\u201d\u00a0 In this case, the settling parties took about three weeks to advise the remaining defendants and the court of the partial settlement.\u00a0 The settling parties argued that by any yardstick, this would satisfy the term \u201cimmediately.\u201d\u00a0 The lower court and appellate court disagreed.\u00a0 To this end, the appellate said: \u201cThe standard is \u201cimmediate\u201d; it is not \u201ceventually\u201d or \u201cwhen it is convenient\u201d. As the motion judge said: \u201cThe rules really can\u2019t be any clearer. Where an agreement involves a party switching sides from its pleaded position, it must be disclosed as soon as it is made.\u201d \u00a0The appellate court seems to be swayed by the following comments made by the motions judge below:<\/p>\n<p>\u201c\u2026. although the failure to immediately disclose a settlement agreement may adversely affect other parties to the litigation, judges may also be impacted. As he wrote:<\/p>\n<p>I, for one, read the evidence before I read the parties\u2019 factums. In preparing for the motion, <u>due to the misleading manner of presentation<\/u>, I would not have known at the outset, <u>as required<\/u>, that the defendant Secure was on the plaintiff\u2019s side pursuant to a settlement agreement that requires its support to the plaintiff\u2019s satisfaction.
